These terms govern your use of Timestamped GPS. By using the app or verification service, you agree to them. If you do not agree, do not use the service.
The service
Timestamped GPS helps create field photos, videos, timestamps, location labels, project records, checklists, timesheets, reports, and optional public verification records. Features may vary by platform, configuration, region, and subscription status.
Timestamped GPS records device and service assertions. A stamp, file fingerprint, verification code, or registration result does not independently prove what a camera saw, authenticate a person, establish a physical location, or determine legal or regulatory compliance.
Your records and responsibilities
You retain responsibility for the content you capture, enter, publish, export, or share. You must have the permissions and lawful basis required to photograph a site, record audio, process location information, use a company logo, and share records with other people.
You are responsible for reviewing every stamp, checklist answer, report, and export before relying on or delivering it. Do not use Timestamped GPS as the sole control for safety-critical, emergency, payroll, legal, or compliance decisions.
Acceptable use
You may not abuse the service, interfere with its operation, bypass access or rate limits, attempt unauthorized access, publish unlawful content, misrepresent altered evidence as independently authenticated, or use another person’s confidential information without authorization.
Timestamped GPS Pro
Paid features are sold as auto-renewable subscriptions through Apple when enabled. The App Store shows the localized price, billing period, renewal terms, and any trial eligibility before confirmation. Payment, renewal, cancellation, refund, and subscription management are handled through your Apple account and Apple’s applicable terms. Restore Purchases is available in the app.
If Pro expires, the app may stop allowing new Premium actions and may resume Timestamped GPS-controlled ads. Existing captures, verification records, timesheets, project labels, saved profiles, and generated report files are not intentionally deleted or hidden because a subscription ends.
Availability and retention
Local records can be lost if the app or device is removed, damaged, reset, or unavailable. Back up important exports yourself. Public verification records normally expire after their stated retention period and may be deleted earlier using a valid deletion credential or support process.
The service may change, pause, or discontinue features to maintain security, comply with law, or improve the product. No online service is guaranteed to be uninterrupted or error-free.
Third-party services
Apple, Apple Weather, RevenueCat, Google (advertising and sign-in), mapping and location providers, hosting providers, and destinations you choose for sharing or export may apply their own terms and privacy policies. Kyle Becker is not responsible for third-party services outside its control.
No evidentiary or legal guarantee
Timestamped GPS records and verifies technical assertions: that a file matching a fingerprint was registered at a stated time with stated metadata. A stamp, Photo Code, verification result, or proof page is not a guarantee that a photograph is authentic, unaltered before capture, taken by a particular person, or acceptable as evidence in any court, arbitration, insurance process, or regulatory proceeding. Whether a record satisfies an evidentiary, contractual, or compliance requirement is decided by the person or body applying that requirement, not by Kyle Becker.
If you view a verification result or proof page for someone else's capture, you receive it as-is, for information only. Kyle Becker does not owe a duty of care to, and does not accept liability toward, anyone who relies on a verification result, whether or not they hold an account or agreed to these terms. Independently evaluate any record before acting on it.
Disclaimers
To the maximum extent permitted by law, Timestamped GPS is provided “as is” and “as available,” and Kyle Becker disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. Clock, GPS, address, weather, and map data depend on device sensors and third-party services and can be wrong, unavailable, or spoofed at the device level. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by law: (a) Kyle Becker is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, or the cost of substitute services, even if advised of the possibility; and (b) the total aggregate liability of Kyle Becker for all claims relating to the service, on any legal theory, is limited to the greater of fifty U.S. dollars (US $50) or the amounts you paid for the service in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations; in those jurisdictions these limits apply to the fullest extent permitted. The limitations in this section are fundamental to the bargain between you and Kyle Becker and apply even if a remedy fails of its essential purpose.
Your indemnity
You will defend and indemnify Kyle Becker against claims, damages, and reasonable costs (including attorneys' fees) arising from content you capture, publish, or share; your use of the service in violation of these terms or the law; or your violation of another person's rights, including privacy and publicity rights of people appearing in your captures.
Disputes, arbitration, and class waiver
Read this section carefully — it affects your rights. Before filing a claim, email support@timestampedgps.com with a description of the dispute; both sides will try in good faith to resolve it within 30 days.
If informal resolution fails, you and Kyle Becker agree that any dispute arising out of or relating to the service or these terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, and the Federal Arbitration Act governs this agreement to arbitrate. Arbitration will be conducted in English, in your U.S. county of residence or by remote means. Either side may instead bring an individual claim in small-claims court, and either side may seek injunctive relief in court for infringement or misuse of intellectual property or for unauthorized access to the service.
Class and jury waiver: disputes will be resolved only on an individual basis. Neither you nor Kyle Becker may participate in a class, collective, consolidated, or representative action, and both sides waive any right to a jury trial, to the extent these waivers are permitted by law.
Opt-out: you may opt out of this arbitration agreement by emailing support@timestampedgps.com with the subject “Arbitration opt-out” within 30 days of first accepting these terms. Opting out does not affect any other part of these terms.
These terms are governed by the laws of the State of California, excluding its conflict-of-laws rules. Any claim not subject to arbitration will be brought in the state or federal courts located in California, and both sides consent to their jurisdiction.
App Store terms
The iOS app is licensed, not sold, to you. These terms are between you and Kyle Becker, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing claims relating to it, including product liability, regulatory compliance, and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these terms as they apply to the iOS app and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
Copyright and takedowns
Photos displayed on public proof pages are published by their owners. If you believe a published photo infringes your copyright, send a takedown notice to support@timestampedgps.com with: (1) identification of the copyrighted work, (2) the proof-page link for the material, (3) your contact information, (4) a statement that you have a good-faith belief the use is not authorized, and (5) a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner, with your physical or electronic signature. Kyle Becker responds to valid notices by removing or disabling access to the material and may terminate repeat infringers' access to publishing. Counter-notices may be sent to the same address.
Termination
You can stop using the service at any time; deleting the app does not by itself cancel an Apple subscription. Kyle Becker may suspend or terminate access to online features for violations of these terms, to protect the service or other people, or to comply with law. Sections that by their nature should survive — including the evidentiary disclaimer, disclaimers, limitation of liability, indemnity, and dispute terms — survive termination.
Miscellaneous
These terms and the privacy policy are the entire agreement about the service. If a provision is found unenforceable, the rest remains in effect, except that if the class waiver is found unenforceable as to a particular claim, that claim shall proceed in court rather than arbitration. A failure to enforce a provision is not a waiver. You may not assign these terms; Kyle Becker may assign them in connection with a merger, acquisition, or sale of assets. Except for Apple as described above, there are no third-party beneficiaries.
Changes
We may update these terms. Material changes will be reflected by updating the effective date. Continued use after updated terms take effect constitutes acceptance where permitted by law.
